Imageware AS, Subcostume., Imageware.no, Styleupcover.com and other sites operated by Imageware AS are in the terms below and other information on this site referred to as Subcostume.

All the specifications and figures presented in Subcostume.'s product information and price lists are subject to change and adjustment without a specific warning. Customers will be informed in cases where changes have been made in relation to goods that have already been ordered. Please be advised that there may be mistakes in product information published on the Internet due to changes made by the supplier without prior notice. Subcostume. are not responsible for compensating such incidences retrospectively.

Orders can only be placed through our web shop. Our web shop is open for business 24 hours a day all the year round.

All our orders are delivered by Suntek, Hongkong Post and Speedpost.

Subcostume. guarantees that merchandise should be delivered free from production flaws. In the event of faulty merchandise being delivered we would kindly ask you to return the goods in accordance with our regulations for return.

All prices and amounts quoted are exclusive of value added tax (VAT) and freight/postage. Prices will be subject to alteration in the event of changes in supplier's prices, changes in international exchange rates, customs duties and other kinds of rates and taxes. Unless otherwise agreed no price offer from Subcostume. is valid for more than 15 days. If the delivery of goods is subject to a major delay the customer will be notified by e-mail. Customers are therefore required to register their e-mail address correctly in our system.

We do not operate with a sales deposit, since customers pay exclusively in advance.

You are responsible for compliance with all local laws, and you are required to comply with U.S. export laws and regulations when you use or export any software or materials provided through the Service.

In the event of purchased merchandise causing damage to other items because the product does not meet safety standards the user or the public normally expect, Subcostume. will be responsible for compensation as far as such responsibility is applicable according to law of 23. December 1988 no. 104 concerning product responsibility. Other kinds of product related damage will not be compensated.

Under these terms, you may NOT place any of the following material or obtain any such material using the design studio:

- Any threatening, obscene, pornographic or profane material or any other material that could give rise to any civil or criminal liability under applicable law
- Any material that could infringe rights of privacy, publicity or copyrights without the permission of the owner of these rights and the persons (or their parents or legal guardians, where applicable) who are shown in the material
- Any material sent from an anonymous or false address.

While Subcostume. is not responsible for the content of the submissions, Subcostume. reserves the right to delete, move or edit submissions that it, in its sole discretion, deems abusive, defamatory, obscene or in violation of copyright or trademark laws or otherwise unacceptable. Subcostume. reserves the right to share certain account information with governmental organizations or other third parties. If you dispute any copyright or trademark infringement claims, we will share with you the contact information of any party claiming any such infringement. In the event of any such dispute, Subcostume. reserves the right to suspend production and shipment of the products been resolved. In addition, you warrant that all moral rights in any uploaded materials have been waived.

Your physical or electronic sharing of your images constitutes permission for reprinting by the recipient. Subcostume. will not be liable for the content of any submission.

Our sites and the content may be used only to design and order printed material from Imageware. Any other use, including, but not limited to, reproduction, modification, distribution, redistribution, publication, or republication of any or all of the content our sites is strictly prohibited. The content, our websites or any portion of our sites may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any purpose, commercial or otherwise, that is not expressly permitted by Imageware in writing. The content and software on our websites may only be used as a shopping resource. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content, information, software, products, or services obtained from our sites. In addition, the method of purchasing and the software used in its implementation is proprietary in nature and may not be copied under any circumstances. Customer has a license to use our websites for the purposes of researching and purchasing only. The license to use our sites shall not be construed as permission for Customer to copy, modify, or imitate the proprietary purchasing software, user interface or any other aspect of the Site.

If Subcostume. should be prevented from delivering or carrying out a mandatory replacement delivery or should such a mandatory replacement delivery be deemed unreasonable as a result of a labor conflict or some other comparable kind of incident where the parties have no control over the situation such as fire, war, mobilization or an unforeseen military call up of similar dimensions, requisition, seizure of assets, monetary restrictions, revolt and tumult, lack of means of transport, general lack of goods, fuel restrictions and defects and other delays affecting delivery from suppliers or, manufacturers as a result of such occurrences as described in this point - Imageware will be exempt from all other responsibility than the money back claim and will subtract this amount from the total sum due.

Any action hereunder must be brought, if at all, within one (1) year from the accrual of the cause of action. Disputes regarding terms of purchase and regulations in that connection, as well as disputes concerning legal matters mentioned in or derived from the afore mentioned terms and regulations are deemed to be under the jurisdiction of the regular courts of law in this case Oslo magistrates court. Unless a written agreement to the contrary be made between the parties concerned all legal matters arising are subject to Norwegian law.

To the fullest extent permitte3d by applicable law, under no circumstances shall Subcostume. be liable for any indirect, incidental, special or consequential damages, including, but not limited to, damages for loss of profits, use, data or other intangibles, even if Imageware has been advised of the possibility of such damages, that result from the use or the inability to use the Imageware websites or services, from any changes to our sites or its services, or from unauthorized access to or alteration of your transmission or data. Some jurisdictions do not allow the limitation or exclusion of incidental, consequential or other types of damages, so some of the above limitations may not apply to you.
